Terms of Service

1. Service Description

NextGenIQ LLC ("NextGenIQ," "we," "us") provides AI agent trust evaluation services through the NGIQ-ATE framework. Our services include agent evaluation, trust scoring, badge issuance, and verification. By engaging our services or using nextgeniq.app, you agree to these terms.

2. Evaluation Scope

Each evaluation is scoped to the specific agent, environment, and context declared during the discovery phase. The evaluation context (industry, company size, use case) and scoring profile are disclosed on every badge and verification page.

An evaluation reflects a point-in-time assessment within the declared scope only. It does not extend to use cases, environments, configurations, or versions not covered by the evaluation.

3. Behavioral Disclaimer

NextGenIQ does not certify, guarantee, or warrant agent behavior. We evaluate whether an agent and its operating organization meet defined governance, security, and capability standards at the time of evaluation.

A trust badge indicates that the agent met the evaluation criteria within the declared scope. It is not a warranty of future behavior, safety, or performance. Agent behavior may change due to model updates, configuration changes, data drift, or operational changes outside NextGenIQ's visibility.

4. Client Obligations

Clients engaging NextGenIQ for evaluation agree to:

  • Provide truthful and complete evidence for the evaluation
  • Notify NextGenIQ of material changes to the agent or its operating environment
  • Not misrepresent the scope or meaning of the evaluation badge
  • Not display a suspended or revoked badge as active
  • Not modify, alter, or create derivative versions of NextGenIQ badges
  • Maintain the agent's configuration within the evaluated scope during the badge validity period

5. Badge Usage

Trust badges issued by NextGenIQ may be displayed on the client's website, documentation, and marketing materials using the provided embed code. Badges must link to the verification page at nextgeniq.app/verify/[id].

Badges are non-transferable. A badge issued for one agent may not be displayed for a different agent. Misuse of badges may result in revocation.

6. Confidentiality

NextGenIQ treats all evaluation evidence, organizational documentation, and agent architecture details as confidential. We will not disclose client evidence to third parties without written consent.

The following are public by design: the trust badge, verification page data (trust level, designation, domain scores, evaluation context), and the evaluation ID. Clients consent to this disclosure by requesting an evaluation.

7. Limitation of Liability

NextGenIQ's liability is limited to the fees paid for the evaluation service. We are not liable for damages arising from agent behavior, deployment decisions made based on evaluation results, or third-party reliance on trust badges.

NextGenIQ does not provide legal, regulatory, or compliance advice. Our evaluations reference published standards (NIST AI RMF, CSA, eIDAS 2.0) but do not constitute certification under any regulatory framework.

8. Property Analysis Tool

The NextGenIQ Property Analyzer is provided for informational and research purposes only. It does not constitute financial, investment, legal, or real estate advice.

  • No investment advice. Deal scores, yield estimates, cash flow projections, and AI verdicts are analytical outputs based on modeled assumptions. They are not recommendations to buy, sell, hold, or finance any property.
  • Data accuracy. Property data, market comparables, rental estimates, and economic indicators are sourced from third-party data providers. NextGenIQ does not warrant the accuracy, completeness, or timeliness of this data. Market conditions change; results reflect data available at the time of analysis.
  • Model limitations. Projections and scores are generated by algorithmic models. All models contain assumptions and limitations. Actual investment outcomes may differ materially from projected results.
  • User responsibility. Any decision to purchase, invest in, finance, or pass on a property is solely your responsibility. NextGenIQ is not liable for decisions made based on analyzer outputs.
  • No fiduciary duty. Use of the Property Analyzer does not create a fiduciary, advisory, or professional relationship between you and NextGenIQ.
  • Shareable reports. When you generate a shareable report link, that link may be accessed by anyone you share it with. Do not share reports containing non-public information about properties you do not own or have authorization to disclose.
  • Professional consultation. Before making any real estate investment decision, consult a licensed real estate agent, financial advisor, or attorney familiar with your specific circumstances and local regulations.

9. Dispute Resolution

Disputes arising from these terms or evaluation services will be resolved through good-faith negotiation. If unresolved within 30 days, disputes will be submitted to binding arbitration in Austin, Texas under the rules of the American Arbitration Association.

10. Modifications

NextGenIQ may update these terms with 30 days' notice. Continued use of services after notice constitutes acceptance of updated terms. Material changes will be communicated via email to active clients.
